FACTS
On Sept. 25, 2014, plaintiff Chase Henrich, 24, a manager of Active Ride Shop, a skateboarding and snowboarding retailer, was seated on his motorcycle when he was struck by a vehicle operated by Veronica Hackbarth. Henrich claimed to his knee. Henrich sued Hackbarth, alleging that Hackbarth was negligent in the operation of her vehicle. Hackbarth admitted liability., Henrich sustained a tear of a knee’s anterior cruciate ligament and a fracture of a leg’s tibial plateau. He subsequently underwent arthroscopic ACL reconstruction and nine months of physical therapy. Henrich claimed that he missed five months of work and then was put on light duty for two months. He also claimed that although he currently has no daily limitations, he will likely develop arthritis in the future. Thus, Henrich sought recovery of $30,364.50 in past medical costs and $19,570.31 in past lost earnings. He also sought recovery of damages for his pain and suffering. Defense counsel disputed the cause, nature and extent of Henrich’s alleged and economic damages.
