FACTS
On Feb. 2, 2010, the plaintiff, a 29-year-old sales representative, was riding his MV Agusta motorcycle south on LaCienega Boulevard in Los Angeles. As he approached the intersection with Sawyer Avenue, a Lexus, also traveling south, made an abrupt illegal right-turn into the driveway of a mall and collided with the motorcyclist. The rider subsequently was knocked off his motorcycle, his knee and shoulder. The plaintiff sued the believed driver of the Lexus, alleging that the defendant was negligent in the operation of the motor vehicle. The defendant denied even being at the accident scene on the day of the accident. However, an independent witness placed his vehicle at the scene., The plaintiff was transported by ambulance from the scene to Cedars-Sinai Medical Center in Los Angeles. He sustained a displaced clavicle fracture and a tear of the anterior cruciate ligament of his left knee. His arm was subsequently placed in a sling and his left knee was placed in an immobilizer that day. On Feb. 10, 2010, the plaintiff was readmitted to Cedars-Sinai for open reduction and internal fixation of the clavicle fracture. On March 9, 2010, he was admitted to Kerlan-Jobe Orthopaedic Clinic in Los Angeles, where he underwent a left knee reconstruction with screws. The plaintiff claimed that hardware removal is contemplated for the future. Thus, he claimed past medicals of $30,000, per Howell, and future medicals of $30,000. Plaintiff’s counsel contended that since the plaintiff was a very active young man, he was able to resume most of his prior strenuous activities, but has not gone back to skiing or motorcycle riding. According to defense counsel, the plaintiff claimed that he would require a number of additional surgeries. Thus, defense counsel contended that the plaintiff actually sought recovery of $58,000 in past medicals and $100,000 in future medicals.
