On July 12, 2017, applicant Susan Hellman, 46, a horse trainer, was in the course and scope of her employment with Coral Reef Ranch, in Rancho Santa Fe, when she was thrown off a horse and kicked in the head by the horse that threw her. Hellman sustained to her head, face, a shoulder, knees, and a finger. Hellman filed a workers’ compensation claim against her employer, Coral Reef Ranch, which was insured by the State Compensation Insurance Fund. She brought a claim against the respondent in an attempt to collect workers’ compensation benefits., Hellman sustained a facial bone fracture, a moderately displaced fracture of the mandible, a clavicle fracture, a fracture of a pinky finger, and tears of the anterior cruciate ligament in both knees. She was taken to Scripps Memorial Hospital Encinitas, where it was determined that she suffered a mild traumatic brain injury. Hellman underwent surgery to treat her collarbone, pinky finger and knees. She also underwent massage therapy and chiropractic care to treat her alleged neck pain, and Botox to treat her jaw. In addition, she received some services at a neurorehabilitation center in San Diego. Hellman claimed she continues to have chronic pain in her face and jaw. She also claimed she suffers from psychological issues. Hellman claimed that as a result, she was enrolled in brain injury programs through four different neurorehabilitation services. She also continues to undergo a day treatment program and goes to Scripps Memorial Hospital Encinitas for weekly check-ins. Hellman sought recovery of past and future medical costs, and damages for her past and future pain and suffering. Defense counsel initially contended that Hellman already underwent one neurorehabilitation program and disputed the need for more.
