FACTS
On June 1, 2016, plaintiff Vandy Nou, 38, a heart valve sewer, was driving south on Interstate 5 when her vehicle was rear-ended by a vehicle operated by Juan Serrato. Nou’s vehicle then struck a vehicle operated by plaintiff Brenda Herrera, a student. Nou and Herrera each claimed neck and back . Nou sued Serrato and the co-owner of Juan Serrato’s vehicle, Maria Serrato. Nou alleged that Juan Serrato was negligent in the operation of his vehicle and that Maria Serrato was vicariously liable for Juan Serrato’s actions. Herrera brought a separate suit against the Serratos, as well as against Nou and the co-owner of Nou’s vehicle, Sokun Phay. Herrera alleged that Juan Serrato and Nou were negligent in the operation of their respective vehicles. Herrera also alleged that that Maria Serrato was vicariously liable for Juan Serrato’s actions and that Phay was vicariously liable for Nou’s actions. The cases were consolidated for trial. Judge Hugh Brenner found no evidence of liability against Nou and/or Phay. As a result, Brenner granted Nou and Phay’s counsel’s motion for non-suit, and the matter continued with the claims against the Serratos. Defense counsel argued that Herrera cut off Nou’s vehicle, making Herrera liable for the accident., Nou and Herrera were both taken by an ambulance to a hospital. Nou claimed she sustained sprains and/or strains of her neck and back. She underwent MRIs and several months of chiropractic care. Nou claimed that despite undergoing chiropractic treatment, she continues to suffer from neck and back pain and a limited range of motion. She alleged that as a result, she has difficulty sleeping and with other aspects of daily living. Nou sought recovery of past lost wages for the minimal amount of time she missed from work sewing synthetic heart valves. She also sought recovery of past medical costs, and damages for her past and future pain and suffering. Herrera also claimed she sustained sprains and/or strains to her neck and back. She underwent three months of chiropractic treatment. Herrera claimed she continues to suffer from back and neck pain, which causes her to have difficulty with school. Herrera sought recovery of her past medical costs, and damages for her past and future pain and suffering.
