On July 6, 2013, plaintiffs Eddie Campos, Brooke Campos, Blake Campos, Mike Steinhaus and Morgan Burningham were at their vacation residence by the Colorado River when they were approached by Off-duty, Riverside County Sheriff Deputies Juvien Galzote and Nilo Jose. The deputies arrived at a the lot to determine why Eddie Campos had struck Daniel Arenas Jr. during an altercation earlier that day that also involved Blake Campos and Mike Steinhaus. However, while the deputies were there, another fight broke out among several individuals. The Camposes, Steinhaus and Burningham sued Galzote; Jose; the deputies’ employer, the county of Riverside. They also sued Arenas and several others believed to have been involved in the second altercation, including Stanley Sniff, Brian Laureano, Lisa Miller, Thomas Miller, Vincent Musaraca, Dave Johnson, and Gary Gueverra. Jose brought a counter-claim against Blake Campos and Mike Steinhaus. Several of the alleged assailants named in the initial complaint were let out of the case, and the county was let out on a motion for summary judgment prior to trial. Thus, the matter continued against only Galzote and Jose, as well as on Jose’s counter-claim. Plaintiffs’ counsel contended that Galzote and Jose participated in the second altercation and that the Camposes, Steinhaus and Burningham were all injured in that altercation. Thus, the plaintiffs alleged that Galzote and Jose violated Civil Code § 52.1 by getting involved in the altercation and that the deputies’ actions constituted assault, battery, intentional infliction of emotional distress, and false imprisonment in violation of their civil rights. Defense counsel for the deputies argued that Jose and Galzote were not on-duty at the time of the incident and that the deputies were not actively involved in the altercation, except to attempt to break it up. Counsel also argued that Jose was attacked by Blake Campos and Mike Steinhaus during the deputy’s attempt to break up the altercation., The only continuing damages complaints at trial involved the plaintiffs’ alleged emotional distress. The Camposes, Steinhaus and Burningham did not seek counseling and do not anticipate undergoing any future counseling. However, they claimed the incident resulted in the loss of use and enjoyment of their vacation property. Thus, the plaintiffs sought recovery of $800,000 in total damages.
