On April 16, 2008, plaintiff Junus Perry, an 11-year veteran of the city of Fresno Police Department in his 40s, was working as a campus police officer at Roosevelt High School when he was knocked to the ground by a wooden baseball bat wielded by a special education student, Jesus “Jesse” Carrizales, who had snuck up behind Perry during a lunch break. Perry then shot Jesse, whom he had never met before the incident, when Jesse was allegedly set to strike him again. The city of Fresno investigated the incident and determined the shooting was in self-defense. Perry sued the Fresno Unified School District, alleging the school district failed to warn him about Jesse. The city of Fresno was a plaintiff-in-intervention in the matter, specifically regarding Perry’s workman’s compensation lien for his medical expenses. Perry’s role at Roosevelt High School had included interacting with students, such as helping them with school and home issues to prevent violence. Plaintiff’s counsel contended that Jesse was classified as emotionally disturbed and that counselors at the school had previously prepared reports detailing that Jesse wanted to die at the hands of a police officer. However, counsel contended that district officials never told Perry that Jesse, who was allowed to roam unsupervised among fellow students, had mental illness. Perry claimed that if he had known about Jesse’s mental condition, he might have been better prepared to deal with him. Jesse’s family claimed that their son was taking the antidepressant Lexapro, as well as the antipsychotic drug Geodon for depression at the time of the incident., Perry was struck in the head by a wooden baseball bat. He subsequently sustained a fractured skull and a neck injury. He also claimed he continues to suffer emotional distress and trauma from the shooting of Jesse.
