FACTS
On Aug. 27, 2012, at around 2 a.m., plaintiff Steve Perez, 21, and his brother got into an altercation that resulted in two 911 calls to the police. As a result, police arrived at the apartment in the 200 block of North Western Avenue, in Anaheim, and Officers Stephen Craig and Stephen Salicos dragged Perez outside and handcuffed him. Perez claimed that during the incident with the police, he suffered to his face, neck and back. Perez sued the officers’ employer, the city of Anaheim. Craig and Salicos were later substituted in for “Doe” defendants. Perez alleged that the officers’ use of force was excessive and that the city was negligent in the training of Craig and Salicos. The city counter-sued against Perez for allegedly sustained by Craig during the incident. Perez claimed that he did not resist arrest, but that Craig and Salicos still dragged him outside, handcuffed him, and beat and kicked him. The officers claimed that inside the apartment, Perez, who admitted to being highly intoxicated, charged at Craig and punched the right side of Craig’s face. They claimed that Perez then forcefully resisted their efforts to restrain him, causing Perez to injure Craig. Thus, the officers claimed that they used lawful force to subdue a heavily-intoxicated and combative Perez., Perez claimed he suffered abrasions and contusions to his face, neck and back. Immediately after the incident, he was taken to Anaheim Memorial Medical Center, in Anaheim, where he was briefly examined and given medical clearance prior to being taken to jail. Perez’s mother, Petra Feria, claimed emotional distress from witnessing the incident. However, she acknowledged that she did not undergo counseling for her alleged condition.
