FACTS
On May 26, 2016, plaintiff Christopher Clausen was driving on the northbound side of Jellick Avenue, in Rowland Heights. The front end of his car collided with the front, driver’s side of an unmarked Los Angeles County Sheriff’s Department vehicle. The driver of the unmarked police vehicle, Joel Flores, was on duty and making a left turn out of the parking lot for Jellick Elementary School onto the southbound side of Jellick Avenue when the collision occurred. Clausen sustained to his chest. Clausen sued Flores and Flores’ employer, the county of Los Angeles. Clausen alleged that Flores was negligent in the operation of his vehicle and that the county was vicariously liable for Flores’ actions. Plaintiff’s counsel contended that Flores was inattentive and making an unsafe left turn as he exited the parking lot, causing the crash. Flores claimed he did not see any approaching vehicles when he looked left to make his turn., Clausen sustained a fractured sternum. He was transported to the University of California, Irvine Medical Center, in Orange, where he was treated and released. Clausen sought recovery of past and future medical costs, and damages for his past and future pain and suffering. His wife, Natalya Clausen, presented a derivative claim seeking recovery for her loss of consortium.
