In 2007, plaintiff Da Hoon Chung, 15, began attending camp and being a full-time student while hosted by Smart Educational Consultant, a Calabasas-based hosting service that caters to South Korean families who wish to have their children attend either camp or school in the Los Angeles area. Chung claimed that he suffered sexual battery, assault and intentional infliction of emotional distress while hosted by Smart Educational Consultant from 2007 until 2011. Chung sued Jay Yoo, who operates Smart Educational Consultant; Jay Yoo’s husband, Man Yoo; and the Yoos’ two sons, Stephen Yoo and Justin Yoo. Chung alleged that Jay Yoo and her family were liable for the sexual battery and assault. The Yoos denied any liability. Defense counsel contended that after attending camp and being a full-time student for over three years, Chung left the hosted service in 2011, and a financial dispute arose between Chung’s family and Jay Yoo. Counsel contended that Jay Yoo then filed suit for unpaid fees, and received a judgment in Korea. Counsel contended that after that Jay Yoo received judgment, Chung filed this suit alleging various claims against Jay Yoo and her family. Thus, defense counsel argued that the Yoos were not liable for any of the claims made against them and that Chung only filed suit against the Yoos in response to the prior judgment., Chung claimed he was sexually assaulted and battered while he was a hosted student with Smart Educational Consultant. He alleged he ultimately left the hosted service in 2011, when he was 19, but that he continues to suffer emotional distress. As a result, Chung saw a marriage and family therapist on at least five occasions and a psychologist on two or three occasions. The plaintiff’s medical experts agreed that Chung suffered severe emotional distress. Thus, Chung sought recovery of $2 million in damages.
