FACTS
On Feb. 10, 2015, plaintiffs’ decedent Alexander Sutherland, 27, was found drinking alcohol in the bathroom of a 7-Eleven convenience store on East Yosemite Avenue, in Manteca. As a result, he was taken into custody by Manteca police and transported to the San Joaquin County Jail, where he was placed in a “sobering” cell. Sutherland was later found unresponsive in his cell between 11 p.m. and 12 midnight. He ultimately died. The decedent’s father, Jeffrey Sutherland, and mother, Beverly Tobey, sued the city of Manteca, the Manteca Police Department, the county of San Joaquin, and the San Joaquin County Sheriff’s Office. The decedent’s parents alleged that the responding police officers and correctional officers were negligent in their supervision of Alexander Sutherland. They also alleged that the city, police department, county and sheriff’s office were negligent in the training of the officers, making them liable for the officers’ actions. Plaintiffs’ counsel asserted that the correctional officers were negligent for failing to check on Alexander Sutherland every 15 minutes. Counsel contended that there were two times in which the officers did not check on Sutherland’s well being and that Sutherland was found unresponsive over an hour later. Defense counsel contended that Sutherland was booked into the same jail over 100 times with almost all of those times being for intoxication., Sutherland was found unresponsive in his cell over an hour after the correctional officers last checked on him. He ultimately died. It was ultimately determined that Sutherland had liver disease brought on by excessive alcohol consumption. Sutherland’s parents sought recovery of wrongful death damages based on the loss of their son. Sutherland’s brother, Arron Sutherland, was added as a plaintiff, but he was ultimately dismissed from the case.
