On June 14, 2019, plaintiffs’ decedent Kenneth French, 32, and his parents, plaintiff Paola French and plaintiff Russell French, shopped at a superstore located in Corona. Kenneth French shoved or struck police officer Salvador Sanchez, who was holding his 18-month-old son. Sanchez immediately drew his service handgun and fired 10 shots. The Frenches were struck. Kenneth French suffered a fatal injury; Paola French suffered an injury of her back; and Russell French suffered of his chest and a kidney. Paola French and Russell French, acting individually and as representatives of their son’s estate, sued Sanchez and Sanchez’s employer, the city of Los Angeles. The lawsuit alleged that Sanchez’s actions constituted battery and excessive force, in violation of Kenneth French’s constitutional and civil rights, that Sanchez’s actions also constituted a negligent infliction of emotional distress, and that the city was vicariously liable for Sanchez’s actions. Plaintiffs’ counsel contended that Kenneth French, who suffered schizophrenia and spoke little, was shot while walking away from Sanchez. Sanchez claimed that French violently pushed him to the ground. He also claimed that he believed that he had been shot by French, and he contended that he responded appropriately to protect himself and his son. The city’s counsel contended that Sanchez was not acting in the scope of his employment at the time of the incident., Kenneth French suffered a fatal gunshot wound. French, 32, died at the scene of the shooting, on June 14, 2019. He was survived by his parents. French’s estate sought recovery of wrongful-death damages that included damages for French’s pain and suffering. Paola French suffered a gunshot wound of her back. She briefly became comatose. She claimed that she also suffered emotional distress stemming from the experience of her son’s fatal shooting. She sought recovery of past and future medical expenses, damages for past and future emotional and physical pain and suffering, and damages for past and future loss of consortium. Russell French suffered a gunshot wound of the chest, and he also suffered damage of a kidney. He underwent a nephrectomy: removal of his damaged kidney. French claimed that he also suffered emotional distress stemming from the experience of his son’s fatal shooting. He sought recovery of past and future medical expenses, damages for past and future emotional and physical pain and suffering, and damages for past and future loss of consortium.
