FACTS
On March 1, 2012, at approximately 9 p.m., plaintiff Shalini George, a government employee in her 60s, was walking in a parking lot after leaving the Whittier Narrows Tennis Center, in South El Monte, when she tripped and fell over a piece of rebar that was sticking out of a broken parking block. George claimed to both knees. George sued the maintainer of the parking lot, the county of Los Angeles. George alleged the county’s negligent repair and maintenance of the subject parking block created a dangerous condition of public property. She further alleged that the county had notice of the dangerous condition and that the hazard was difficult to see due to inadequate lighting in the parking lot. Defense counsel argued that George frequented the tennis center and that George should have been aware of the broken parking blocks that existed throughout the lot., One day after the incident, George went to an urgent care facility with complaints of pain to both knees. She was subsequently diagnosed with soft-tissue contusions, which caused swelling in her knees. George then followed up with the urgent care facility a few times for treatment. George claimed she eventually healed from her . Thus, she sought recovery of past medical costs and recovery of damages for her past pain and suffering. Defense counsel argued that George did not suffer a serious injury to her knees, as she made a good recovery with no residual symptoms.
