FACTS
In 2016, plaintiff Hovig Tashjian, a man in his 20s, was using the monkey bars at a Fitness Asylum gym in Rancho Cucamonga when he fell from the bars and struck the gym floor. Tashjian sustained an injury to his jaw. Tashjian sued the gym, Fitness Asylum; the trainer that was monitoring him, Tony Parenti; the trainer’s company, Parenti Inc.; and the manufacturer of the monkey bar castle rig that he was using, Extreme Training Equipment I.E. Inc. Tashjian alleged that the subject monkey bar rig was negligently installed. He also alleged that Extreme Training Equipment negligently designed the monkey bars and failed to adequately warn about the dangers of the rig. Several defendants settled out of the case, and the matter only continued against Extreme Training Equipment. Plaintiff’s counsel contended that the monkey bar castle rig was installed too high, at 12 feet above the ground, and that it should have been installed at a lower height so that if an individual fell from them, he or she would not be injured. Counsel also contended that Extreme Training Equipment failed to adequately warn or instruct of the potential risks of using the monkey bar castle rig. Defense counsel for Extreme Training Equipment argued that there was nothing wrong with the equipment and/or the way it was designed and installed. Counsel also contended Tashjian was responsible for his own injury., Tashjian sustained a jaw fracture. He underwent jaw surgery and had it wired shut for a few months. Tashjian sought recovery of damages for his past and future pain and suffering.
