FACTS
On Oct. 10, 2010, at 7 p.m., plaintiff Aljabbar Shepard, 39, an employee in the restaurant industry, was a passenger in an amusement park bus when it struck another bus in Hollywood. As a result, Shepard was jolted forward and twisted to the right. In addition, glass shards flew inside the bus, landing on his back and in his left eye. Shepard sued the amusement park and its operator. Shepard alleged that the defendants’ bus driver was negligent in the operation of the bus and that the defendants were liable for the operator’s negligence., Shepard was not treated at the scene nor did he have any emergency room treatment later. However, Shepard claimed he sustained a 1-millimeter lower level disc bulge, soft-tissue , and a laceration of his left eye. He alleged that he ultimately developed conjunctivitis as a result of glass shards getting in his left eye during the accident. Thus, Shepard sought recovery of approximately $10,500 in damages.
