On Feb. 1, 2012, at approximately 11:25 a.m., plaintiff Patricia McGrath Lott, an 84-year-old retired woman, was a passenger in a 2010 Buick Lucerne driven by Mary Louise Reid, 83. While they were traveling on eastbound State Route 118 in an unincorporated area of Ventura County, Reid lost control of the vehicle, veered off the road and struck a utility pole. Lott sustained to her neck, sternum, right groin, and left, non-dominant arm. Lott sued Reid, alleging the defendant was negligent in the operation of her vehicle. Specifically, Lott claimed Reid was inattentive and lost control of the vehicle. Reid did not dispute liability., Lott sustained a post-traumatic C5-6 subluxation and a fractured sternum. She was subsequently taken to a hospital via ambulance. On Feb. 1, 2012 and Feb. 2, 2012, Lott underwent a posterior fixation of the C5-6 subluxation, followed by therapy. Lott claimed that she is left with left arm radicular pain and radiculopathy, as well as pain to her lower back, right groin and right knee. Thus, Lott claimed medical expenses in excess of $335,000. However, Medicare had paid $63,768 and had a lien.
