FACTS
On April 27, 2017, plaintiff Claudia High-Mathews exited a bus at the corner of Fifth and Market streets, in San Francisco. When she proceeded to walk across the street, she tripped and fell to the ground. High-Mathews sustained to a foot and an ankle. High-Mathews sued the owner of the roadway, the city and county of San Francisco. High-Mathews alleged that the city and county of San Francisco were negligent in the repair and/or maintenance of the roadway, creating a dangerous condition, and that the city and county of San Francisco failed to warn about the condition. High-Mathews claimed that as she proceeded to cross the street, she stepped into a large crack in the road, which caused her foot to fail beneath her and caused her ankle to twist. She alleged that as a result, she fell., High-Mathews sustained a fracture of a foot and a twisted ankle. She was taken to a hospital, where she was treated and released. High-Mathews sought recovery for her past and future medical costs, and her past and future pain and suffering.
