FACTS
On Aug. 30, 2012, plaintiff Christine Hayden was walking on the sidewalk in front of 1862 Eggbert Avenue in San Francisco when she stepped on a sewer vent cover and it came loose. As a result, Hayden fell to the ground and injured her right shoulder and hand. Hayden sued the owners of the residence she fell in front of, Zhi Bin Chen and Ri Hua Zhu; and the owner of the sewer vent, the city and county of San Francisco. Hayden claimed the sidewalk surrounding the sewer vent was cracked and broken. Thus, she alleged the defendants failed to properly maintain the sidewalk and sewer vent, creating a dangerous condition of public property., Hayden sustained a tear of her right shoulder’s labrum and an avulsion fracture of her right hand’s pinky finger. She also suffered some facial swelling. Hayden subsequently wore a splint on her finger and underwent conservative treatment for her . Thus, she sought recovery for her medical costs. She also sought recovery of damages for her pain and suffering.
