FACTS
On May 6, 2012, at approximately 7:30 p.m., plaintiff Adriana Sandoval, 16, was walking along Monroe Street in Riverside when she entered a marked crosswalk in an attempt to cross the intersection with Hoover Street and was struck by a vehicle operated by Makalanne Van Driel. Adriana claimed to her left hip and head. Jesusa Chavez, acting as Adriana’s guardian ad litem, sued Van Driel. Chavez alleged the defendant was negligent in the operation of his vehicle. Specifically, Chavez claimed Van Driel failed to yield to a pedestrian in a crosswalk while at a traffic light., Adriana was taken by ambulance to and emergency room, where she complained of pain to her left side (in the area of her hip/waist), as well as lacerations to her left hip and forehead. Her lacerations were ultimately sutured, but she claimed she suffered headaches as a result of the accident. Adriana consulted with her primary care physician and specialists for treatment of her scarring. She claimed that other than the scars, she fully recovered from her . Thus, Adriana sought recovery of $5,000 in past medical costs and unspecified damages for her pain and suffering.
