FACTS
On Dec. 15, 2016, plaintiff Jonathan Garcia-Valle was walking west on 24th Street, in San Francisco. When he began to cross Potrero Avenue, he was struck by a vehicle operated by Raymond Honor, who was driving south on Potrero Avenue. Garcia-Valle sustained to his chest and head. Garcia-Valle sued Honor and Honor’s employer, the city and county of San Francisco. Garcia-Valle alleged that Honor was negligent in the operation of his vehicle and that the city and county of San Francisco was vicariously liable for Honor’s actions while in the course and scope of his employment. Plaintiff’s counsel contended that Garcia-Valle was crossing Potrero Avenue in a marked crosswalk with a green pedestrian light and that Honor violated California Vehicle Code § 21950(a) by failing to yield to a pedestrian crossing the roadway in a marked crosswalk., Garcia-Valle sustained fractured ribs, internal bleeding and a traumatic brain injury. He was taken to a hospital, where he was treated and released. Garcia-Valle sought recovery of more than $85,000 in past medical costs and an unspecified amount of future medical costs. He also sought recovery of damages for his past and future pain and suffering.
