FACTS
On June 21, 2017, plaintiff Lu Chen was struck by a truck. The incident occurred in a crosswalk of the intersection of Clay and Powell streets, in the Chinatown area of San Francisco. Chen claimed that she suffered of her ankles, her back, her head, a hip and her knees. Chen sued the truck’s driver, Clifford Lim, and Lim’s employer, the city and county of San Francisco. Chen alleged that Lim was negligent in the operation of the truck and that the city and county of San Francisco was vicariously liable for Lim’s actions while in the course and scope of his employment., Chen sustained a right parietal hematoma and a concussion. She also claimed she sustained to her back, a hip, her knees, her ankles and abrasions to her body. In addition, Chen claimed that she suffers post-concussion syndrome as a result of the accident. Chen sought recovery of past and future medical costs, and damages for her past and future pain and suffering.
