FACTS
On Feb. 8, 2013, plaintiff Asieb Moknen, 36, a part-time parking attendant at Los Angeles International Airport, was at the airport, attempting to cross inside a marked crosswalk at 1 World Way, when she was struck by a pickup truck operated by Richard Young, who was negotiating a left turn from westbound World Way onto southbound West Way. Moknen claimed to her right leg, lower back, and ribs. Moknen sued Young and W.E. O’Neil Construction Co., Young’s employer and owner of the pickup truck. Moknen alleged that Young was negligent in his operation of the truck and that W.E. O’Neil was vicariously liable for his actions, since Young was in the course and scope of his employment at the time of the accident. According to the traffic collision report, Young was at fault for the accident by violating California Vehicle Code § 21950, failing to yield to a pedestrian within a crosswalk. Young and W.E. O’Neil conceded liability for the accident., Moknen sustained a mid-shaft femur fracture of the right leg, an L1 fracture and fractured right ribs. She was subsequently taken by ambulance to an emergency room and was hospitalized for three days. Moknen underwent an urgent intramedullary nail fixation of her fractured femur. She was then transferred to a rehabilitation center in Santa Monica, where she was admitted for three weeks. Moknen claimed she experienced ongoing lower back pain following several months of conservative care. On Oct. 14, 2013, she underwent a one-level lumbar fusion at L4-5. She then followed up with three weeks of aquatic physical therapy. Moknen claimed she is still out of work due to her condition and that she will require another three to six months of recovery time. Thus, she claimed $310,000 in past medical costs and $13,500 in lost earnings ($8,000 worker’s compensation lien). She also sought recovery of damages for her pain and suffering.
