FACTS
On June 29, 2016, plaintiff Anahit Tadevosyan, an unemployed 48 year old, was crossing Verdugo Road, walking east to west in a crosswalk near the intersection with Palmer Driver, in Los Angeles, when she was struck by a vehicle operated by Donald Greisbach, who was making a right turn from Palmer Drive and onto Verdugo Road. Tadevosyan claimed to her back and left knee. Tadevosyan sued Greisbach, alleging that Greisbach was negligent in the operation of his vehicle. Plaintiff’s counsel contended that Greisbach was inattentive when he struck Tadevosyan in the crosswalk. Defense counsel contended that Greisbach observed the roadway two times before he began his turn onto Verdugo Road and that Tadevosyan walked into the side of Greisbach’s vehicle. Counsel also noted that a treating paramedic testified that Tadevosyan told him that she walked into Greisbach’s turning vehicle., Tadevosyan claimed that she sustained herniated lumbar discs at the L2-3 and L5-S1 levels, as well as a meniscus tear to her left knee. She was taken by ambulance to a hospital, where she was treated and released. She then underwent MRIs and treated with physical therapy. Tadevosyan claimed that she will eventually require facet blocks, radiofrequency neurotomies and a laminectomy for her back, and arthroscopic repair for her knee. The plaintiff’s orthopedic surgery and pain management experts opined that Tadevosyan’s were caused by the subject accident. Tadevosyan sought recovery for her past and future medical costs, and her past and future pain and suffering. Defense counsel contended that the subject accident did not cause Tadevosyan’s and that her were degenerative. The defense’s orthopedic surgery expert opined that Tadevosyan’s were nothing more than the natural progression of her pre-existing stenosis and spondylosis.
