FACTS
In April 2015, plaintiff Mandy Kazminy, a pharmacy manager of Iranian descent, was terminated from her position at Woodland Memorial Hospital. Prior to her termination, Kazminy complained that the hospital pharmacy’s computer was not keeping accurate counts of drugs on hand, which caused federal and state pharmacy investigations. She claimed that she was told to manually change the drug counts so that the electronic and paper records matched, but that when she refused, she was subjected to offensive characterizations about her Iranian descent and was ultimately terminated. Kazminy sued the operator of Woodland Memorial Hospital, Dignity Health, which was originally sued as Dignity Health Woodland Healthcare. Kazminy alleged that Dignity Health’s actions constituted whistleblower retaliation, national origin discrimination and wrongful termination. Plaintiff’s counsel contended that Kazminy complained to the hospital’s chief medical office about the suspected fraud in the pharmacy and that within weeks of her complaint, the hospital’s pharmacy director began to build a file of Kazminy’s alleged wrongdoing. Counsel also contended that the hospital’s pharmacy director began to criticize Kazminy for going to higher-ups to ask for additional pharmacy staff and made the disparaging comments about Kazminy’s descent. Defense counsel contended that Kazminy was terminated for policy violations, including improperly sharing password credentials with a former manager to access and approve employees’ payroll. Counsel also contended that Kazminy was terminated for violating patient privacy while correcting a prescription filled in error. In response, plaintiff’s counsel contended that other employees had committed the same policy violations, but that they were not terminated., Kazminy claimed that she suffered from a loss of earnings and benefits as a result of her termination. She also claimed that she suffers from emotional distress as a result of the events. Kazminy sought recovery for her past and future loss of wages and benefits, and for her past and future emotional pain and suffering. She also sought recovery of punitive damages.
