In March 2008, plaintiff Haroon Aziz was terminated from his job as a pharmacy technician at a Walnut Creek pharmacy, which was owned by Longs Drug Stores. In October 2008, Longs was purchased by CVS Caremark Corp. Aziz sued CVS and Longs, claiming violations of the federal False Claims Act. He claimed that between January 2000 and October 2008, Longs routinely overcharged the Medicaid program for prescription drugs purchased in California and five other states by misrepresenting the manufacturer of the drugs when submitting claims. Aziz claimed he was terminated in retaliation for questioning superiors about these misrepresentations. CVS and Longs denied there being any False Claims Act violations. The United States and the state of California declined to intervene in the case., Aziz claimed Longs had overcharged the United States and the state of California for drugs purchased through the Medicaid program over the course of eight years. They were seeking an unspecified amount in damages.
