On Nov, 12, 2010, plaintiff Frederic Madrid, 23, a field military policeman, purchased a used Dodge Ram pickup truck from Angelo’s Kars, a dealership in Oceanside. Madrid claimed that due to fraudulent behavior by the dealership, he experienced a loss of use of the truck, as well as other difficulties. Madrid sued Sports Auto Sales Inc., which did business as Angelo’s Kars and Del Mar Imports. He alleged that the conduct of the dealership violated the California Consumers Legal Remedies Act. According to Madrid, the dealership failed to transfer the title to the truck into Madrid’s name after the sale took place. Furthermore, he claimed that the dealership obtained a fraudulent smog test in order to illegally register the vehicle. He claimed that the dealership concealed the fraudulent smog test when Madrid purchased the vehicle, hiding important information about the vehicle’s title and smog certification. Defense counsel contended that the ownership of the vehicle was legally transferred to Madrid. The dealership denied engaging in any sort of fraudulent activity with regard to the sale of the vehicle., As a result of the fraudulent activity of the dealership, Madrid claimed that he was unable to use the truck due to it not being legal to drive, and he received a higher interest rate on his automobile loan. He also claimed that he experienced emotional distress as a result of the dealership’s fraudulent activity. Madrid’s counsel asked the jury for a recovery of damages, both economic and non-economic, as well as punitive damages. Defense counsel disputed the nature, amount and entitlement to the damages sought by Madrid.
