On Aug. 22, 2018, claimant Lindsay Beery, 29, was driving with her minor daughter in a child safety seat in a rear seat of the vehicle. As they were traveling in Paso Robles, their vehicle was rear-ended by a vehicle operated by Jennifer Moffatt. The force of the collision caused Beery’s vehicle to go down an embankment and strike a tree. Beery sustained to her head, neck, shoulders, abdomen, right foot and lower back. Beery brought claims against Moffatt and the owner of Moffatt’s vehicle, Vicki Silva. Beery alleged that Moffatt was negligent in the operation of her vehicle and that Silva was vicariously liable for Moffatt’s actions. It was ultimately determined that The Vicki Silva Trust was the registered owner of Moffatt’s vehicle and that Moffatt and the trust had separate insurance policies, but both were with the same insurer., Beery sustained a concussion, a cervical strain, a lumbar strain and several contusions. She also complained of pain in her shoulders, abdomen and right foot. Beery was taken to a hospital, where she was treated for her . Beery claimed that although her physical resolved, she witnessed her minor daughter being injured in the accident. She alleged that as a result, she suffers from emotional distress. Beery sought recovery of approximately $25,900 in past medical costs based on the adjusted medical bills from her treatment in the emergency department. She also sought recovery of damages for her pain and suffering.
