On Dec. 21, 2009, plaintiff Hillary Millard, 31, a fitness model, was a passenger in a vehicle traveling along Route 76 in Oceanside. While the vehicle was stopped for a red light, it was rear-ended by a vehicle operated by Marisol Sanelias. Millard claimed to her neck and back. Millard sued Marisol Sanelias and the owner of her vehicle, Patricia Sanelias. Millard alleged that Marisol Sanelias was negligent in the operation of her vehicle and that Patricia Sanelias was vicariously liable for her actions. Marisol Sanelias admitted liability for the accident at the beginning of trial. The matter subsequently proceeded to causation and damages., Millard was taken from the scene of the accident by her father and brought to an emergency room, where she presented with neck and back complaints. Millard was ultimately treated and released, and thereafter, underwent approximately three months of chiropractic care and physical therapy. Millard claimed her spinal pain and discomfort persisted, causing her difficulty with continuing to work as a fitness model. She alleged that as a result, she was ultimately forced to seek employment in another field. Thus, Millard sought $8,805.40 in past medical costs, as well as recovery of damages for her lost earnings and pain and suffering. Defense counsel argued that the collision only caused minor strains and sprains, which required only minimal chiropractic care. Counsel also disputed the costs incurred for physical therapy, arguing that Millard’s pain should have dissipated after a couple of months.
