FACTS
On Dec. 3, 2015, plaintiff Jessica Lacy, 40, was attacked by two pit bulls that escaped from the yard of Jorge Barajas and Rosina Hurtado in Adelanto. Lacy sustained of a leg. Lacy sued Barajas and Hurtado, alleging that the defendants were strictly liable for the dogs’ actions. Barajas and Hurtado admitted that their dogs escaped from their yard while their son took out the trash, but they claimed that their son ran after the dogs and had them both in hand when they reached Lacy’s street. They claimed that Lacy’s dog escaped from her yard and started fighting with their dogs. Barajas and Hurtado claimed that their dogs were then struck with brooms and rakes by Lacy and her family members in an attempt to break up the fight and that one of the dogs turned and bit Lacy once on the leg as a result of Lacy striking them., Lacy sustained a dog bite injury on one of her legs and was taken immediately to a hospital, where she was treated and released. Lacy claimed that she was left with scarring and permanent nerve damage to her leg, which cannot be treated. Her treating neurologist testified that nerve-conduction testing confirmed a severed sural nerve, which cannot be corrected and will not heal on its own. Lacy sought recovery of approximately $300,000 in damages for past and future pain and suffering.
