FACTS
On Dec. 12, 2017, plaintiff John Anderson, 67, a truck driver, was driving in Carson when his vehicle was broadsided by a vehicle operated by Raymond Carreon. Anderson claimed to his neck. Anderson sued Carreon and Carreon’s employer, R&R Transportation Inc. Anderson alleged that Carreon was negligent in the operation of his vehicle and that R&R Transportation was vicariously liable for Carreon’s actions while in the course and scope of his employment. The defendants admitted liability for the accident., Anderson claimed the collision exacerbated his herniated cervical discs at the C4-5 and C5-6 levels. He was taken to a hospital, where he was treated and released. He then underwent physical therapy and received epidural steroid injections. Ultimately, in September 2019, Anderson underwent a two-level cervical fusion. Anderson claimed the fusion surgery provided him with significant pain relief. He alleged that as a result, he was able to return to work. Anderson sought recovery of past medical costs in excess of $400,000. He also sought recovery of damages for his past and future pain and suffering. Defense counsel asserted that Anderson’s could not wholly be attributed to the subject accident and that Anderson’s were, in-part, pre-existing and degenerative, as Anderson received an epidural steroid injection to his neck two months before the incident.
