FACTS
On Sept. 27, 2015, plaintiff Sandy Chumpulpackdee, 62, a retiree, was driving on 183rd Street, in Cerritos. Her vehicle was broadsided by a vehicle operated by Adele Conrad. Chumpulpackdee claimed that she suffered an injury of an ear. Chumpulpackdee sued Conrad. The lawsuit alleged that Conrad was negligent in the operation of her vehicle. Defense counsel conceded liability. The trial addressed damages., Chumpulpackdee claimed that the impact caused cell death in her cochlear hair cells. She claimed that, as a result, she suffer tinnitus in her right ear. Chumpulpackdee sought recovery of damages for past and future pain and suffering. Defense counsel contended that Chumpulpackdee had numerous hearing tests conducted after the accident and that the tests showed that Chumpulpackdee did not have hair cell death. Counsel argued that, based on those hearing tests, Chumpulpackdee could not have had tinnitus. Defense counsel further argued that if Chumpulpackdee had tinnitus, it predated the accident, since Chumpulpackdee had documented pre-existing holes in her eardrums, numerous ear infections, and worked in an occupation that constantly subjected her to loud noises.
