FACTS
On April 3, 2014, plaintiff Michael LoPresti, 54, a trade show manager, was driving down Front Street, in San Diego. As he entered the intersection with West Cedar Street, he was broadsided by a vehicle operated by Christine O’Grady, who was traveling on West Cedar Street. LoPresti claimed to his neck and back. LoPresti sued O’Grady, alleging that O’Grady was negligent in the operation of her vehicle. Specifically, he claimed that O’Grady was driving on the wrong side of the road on West Cedar Street. O’Grady did not dispute liability., LoPresti claimed that he sustained bulging cervical and lumbar discs. After the crash, LoPresti went to work because he allegedly thought that his pain would get better. However, when the pain did not go away, he saw his primary care physician a few days later and underwent MRIs. LoPresti treated with physical therapy, chiropractic care and orthopedic treatment. The plaintiff’s expert orthopedic surgeon opined that LoPresti’s were caused by the accident. LoPresti claimed that he continues to work through his pain. He sought recovery of $29,525.11 for past medical costs and an unspecified amount for future medical costs. He also sought recovery of non-economic damages for his past and future pain and suffering. Defense counsel disputed the reasonableness and extent of LoPresti’s alleged . Counsel noted that LoPresti did not go to an emergency room after the accident, and argued that LoPresti’s alleged were normal or pre-existing.
