In January 2016, plaintiff Mykyn Woods 41, a senior community manager, was terminated from her position at Greystar Management Services, LP, a rental housing operator. Woods was previously involved in a serious motor vehicle accident on Nov. 30, 2015. She suffered herniated discs, of an ankle and a knee, and a concussion resulting in post-concussive syndrome and headaches. Woods was temporarily disabled and unable to work at her normal, full-time capacity, in which she worked eight hours on-site per day, five days per week. She requested to work part-time and/or from home prior to being terminated by her immediate supervisor and the human-resources representative. Woods sued Greystar Management Services, alleging that Greystar’s actions constituted disability discrimination, a failure to accommodate and a failure to engage in the interactive process. Plaintiff’s counsel contended that instead of reasonably accommodating Woods, Greystar terminated Woods 44 days after her accident. Defense counsel argued that Greystar did not have a legal duty to accommodate Woods beyond giving her four unpaid weeks off from work., Woods has extensive experience working in residential/commercial real estate management, including the “lease-up” of new construction. She claimed that she suffered from emotional distress and a loss of earnings as a result of her termination. Woods sought recovery of $308,762.68 in past lost earnings and $1.45 million in future lost earnings. She also sought recovery of damages for her past and future emotional pain and suffering. In addition, Woods sought recovery of punitive damages against Greystar for allegedly misrepresenting that Woods’ termination was an “undue hardship” on the company, when plaintiff’s counsel noted that Greystar has offices and employees nationwide, as well as in Mexico, China, Australia, Spain, Chile, the United Kingdom, France and the Netherlands and that Greystar had more than 400,000 units under its management, as of 2014.
