On Oct. 9, 2016, plaintiff Catarnia Lopez, 70, tripped and fell over a concrete ledge while visiting family at an apartment building located at 3940 W. Ingraham St., in Los Angeles. She sustained to both forearms. Lopez sued the owner of the apartment building, Ingraham Properties, LLC, and the apartment building’s management company, MFR Realty & Management Inc. Lopez alleged that the defendants failed to properly repair and maintain the apartment building, creating a dangerous condition. Lopez’s counsel contended that the guardrail on the concrete ledge was painted a dark color, making it difficult to see. Counsel also contended that the apartment building’s lights were not properly operating, which made the entrance of the building dark. Counsel asserted that as a result of the dangerous conditions, Lopez tripped and fell. Defense counsel contended that Lopez should have noticed the concrete ledge. Counsel also contended that the lights were operating on the evening of the incident and that no one else walking with Lopez tripped over the ledge like she did., Lopez sustained a volar shear fracture of the right wrist’s distal radius, and fractures of left arm’s radial shaft and distal ulna. She was immediately taken to a hospital, and ultimately underwent open reduction and internal fixation surgery to treat her fractures. Lopez sought recovery for her past and future pain and suffering.
