On Aug. 27, 2016, the plaintiff, 24, an exchange student from Germany, went on a date with Michael Klassen. The plaintiff claimed that she consumed an excessive amount of alcoholic beverages, resultantly lost consciousness and was raped by Klassen while she was unconscious. The plaintiff sued Klassen, alleging that Klassen’s actions constituted rape and sexual assault. The plaintiff claimed that, during the date, Klassen gave her so much alcohol that she blacked out. Plaintiff’s counsel contended that the plaintiff was new in town and did not know anyone, so after the incident, the plaintiff went to an emergency room to undergo a rape kit examination. Counsel contended that the police were contacted and that Klassen was investigated, but that the police did not pursue a case against Klassen. Klassen was served with the lawsuit while he was living in Santa Barbara, but he relocated out of state and did not appear at court to contest the matter., The 24-year-old exchange student was allegedly raped during a date. She presented to an emergency room, where she underwent a sexual assault forensic exam with the use of a rape kit. She claimed that she suffers from anxiety and post-traumatic stress disorder as a result of the incident. As a result, the plaintiff underwent multiple sessions of therapy and ultimately returned to Germany. The plaintiff claimed that she will continue to need additional therapy and that her career and education were put on hold while she deals with the aftermath of the subject incident. The plaintiff sought recovery of future medical costs and damages for her past and future emotional pain and suffering.
