FACTS
In August 2012, plaintiff Starlin Mohamud, a social worker in her 30s, was on a street corner in San Diego when she was allegedly attacked. Mohamud claimed Asili Farah approached in a car with her two children, exited the car and then assaulted her down to the ground. Mohamud claimed primarily to her face, back and left ankle. Mohamud sued Farah (also known asAsili Mohamud Jama); Farah’s husband, Omar Jama; and two children, Muzamil and Muuad Jama, who were represented by their guardian ad litem, Leeban Magan. Mohamud alleged the defendants’ actions constituted civil assault and battery. Omar Jama and the two children were voluntarily dismissed from the action, ant the matter proceeded to a bench trial against Farah only. Mohamud claimed the unprovoked attack stemmed from a family/friends feud. Plaintiff’s counsel presented two eyewitnesses who claimed they saw the assault, as well as one witness who allegedly assisted Mohamud following the attack. Defense counsel contended that Mohamud’s allegations were a total fabrication, in that Farah never attacked Mohamud. Counsel also presented character witnesses for Farah at trial., On the date of the accident, Mohamud went to an emergency room, where she was treated for scrapes and bruises on her face and body. She also claimed strains and sprains of her back, and a left ankle sprain. Mohamud’s left foot was ultimately placed in a boot for a few months. She also underwent a few months of chiropractic care and physical therapy. Mohamud claimed that her have fully healed, but that she suffers some minor emotional distress as a result of the incident. Thus, she sought recovery of $3,000 in past medical costs and $50,000 in punitive damages for Farah’s alleged malicious conduct. Defense counsel fully denied Mohamud’s allegations, contending that Farah caused Mohamud no physical injury or damages.
