On Sept. 20, 2011, plaintiff Muyleng Bardon, 53, a quality control II worker for MicroVention Inc., left her employment. She claimed that she was constructively discharged and forced out of her employment due to her age and Asian race. Bardon sued MicroVention Inc. and her supervisors, Michael Schwartz and Maggie Guzman. Bardon alleged that the defendants’ actions constituted constructive discharge, age discrimination, race discrimination, retaliation, harassment, and intentional infliction of emotional distress. Bardon claimed that she was subjected to constant comments regarding her age, breast implants, and being the Asian who was “married to the American.” She also claimed that she complained repeatedly about the discrimination, but she felt that the company took no action to protect her rights. Bardon claimed that instead, she was demoted and retaliated against because of her repeated complaints. Defense counsel contended that the defendants took all appropriate actions, that Bardon was never discharged from her employment, and that neither age nor race played a factor in the company’s decision to move Bardon back to the “clear room.” Counsel further contended that Bardon was not discriminated against by anyone., Bardon left MicroVention Inc. on Sept. 20, 2011. She claimed that as a result, she suffered a loss of income and emotional distress. She also claimed that she has been unable to work ever since her constructive discharge. Bardon ultimately sought medical assistance for her depression since the date she left the company. Bardon also sought punitive damages for the alleged malicious actions of her employer.
