FACTS
On July 8, 2016, plaintiff Martha Valenzuela, 59, was driving on Lone Hill Avenue, in San Dimas, when her vehicle entered an intersection with Cienega Avenue and was struck on the front corner by a vehicle operated by Richie Bowman, who was attempting to make a left turn from Cienega Avenue onto Lone Hill Avenue. Valenzuela claimed to her head, left shoulder and right knee. Valenzuela sued Bowman, alleging that Bowman was negligent in the operation of her vehicle. Plaintiff’s counsel contended Bowman made an unsafe turn in front of Valenzuela’s vehicle, causing the crash. Defense counsel argued that Valenzuela was speeding, making her responsible for the crash., Valenzuela was immediately taken to a hospital, where she claimed to her head and left shoulder. She also claimed she sustained a meniscal tear of her right knee. Valenzuela underwent a meniscus repair in 2018. Her other ultimately resolved. Valenzuela claimed that a total right knee replacement was recommended, but that she has not undergone it yet. Valenzuela waived her past medical costs, but sought recovery of future medical costs for the recommended knee replacement. She also sought recovery of damages for her past and future pain and suffering. Defense counsel argued that Valenzuela’s knee injury was not caused by the subject accident and that all of Valenzuela’s were due to age-related degeneration.
