FACTS
In 2015, plaintiff Julie Valencia, an investigator for the Los Angeles County Alternate Public Defender, began working with another investigator at Alternate Public Defender locations. Valencia claimed the other investigator, who was a lesbian, made sexualized comments and remarks that made her uncomfortable. Valencia eventually reported the alleged sexual harassment to her and the other investigator’s supervisor, but Valencia claimed the supervisor failed to do anything about it. Ultimately, in 2017, Valencia left her position. Valencia sued the county of Los Angeles. She alleged that the other investigator’s actions constituted sexual harassment and that the county failed to prevent the harassment in violation of California’s Fair Employment and Housing Act. Plaintiff’s counsel contended that despite Valencia being uncomfortable with the comments, the other investigator continued to make sexualized comments and remarks, including references or comments about Valencia’s genitalia. Counsel also contended that the other investigator made insinuations or statements about wanting a sexual relationship with Valencia. Plaintiff’s counsel asserted that when Valencia complained about the other investigator’s actions, Valencia’s supervisor agreed that the comments were inappropriate, but did nothing to prevent or stop the harassment. Counsel further asserted that the supervisor failed to investigate the complaint or take any corrective action against the other investigator. Defense counsel denied that any harassment occurred, as the other investigator refuted Valencia’s claims and denied making any such comments. In addition, Valencia’s supervisor claimed that Valencia never reported any of the alleged comments to him., Valencia was an investigator with the Alternate Public Defender from March 2012 until 2017. She claimed she left her position with the Alternate Public Defender as a result of the events, but she was ultimately able to obtain new employment. Valencia also claimed that she suffered from emotional distress as a result of the events. Valencia sought recovery of damages for her emotional pain and suffering.
