FACTS
On Oct. 14, 2010, at 4:30 p.m., plaintiff Sandra Carter, 47, an office clerk, was walking down a hallway at Barbour & Floyd Medical Associates, located at 2640 Industry Way in Lynwood, when she allegedly stumbled and hit into a door. Carter claimed to her neck, and right shoulder and arm. Carter sued the building owners, ERC Property Management, LLC and Economic Resources Corp. She alleged the defendants’ failure to repair and/or maintain the hallway created a dangerous condition. ERC Property Management, LLC and Economic Resources Corp. subsequently brought a third-party complaint against Barbour & Floyd Medical Associates, seeking indemnification. Carter claimed that a leaky roof caused the hallway’s ceiling tiles to become wet and damaged. She alleged that as a result of the defendants’ failure to maintain/repair this condition, the wet and damaged ceiling tiles fell on her right side and caused her stumble and hit the door. Counsel for ERC Property Management and Economic Resources Corp. denied the incident ever happened., Carter sustained a contusion to her right, dominant shoulder, as well as to her neck. She claimed she also suffered a supraspinatus tear of her right shoulder. Carter alleged that pain in her right shoulder and neck radiated down her right arm, and on Jan. 18, 2011, she underwent repair of her right shoulder tear. She also underwent two rounds of physical therapy. When Carter complained that she had no relief from the pain, she underwent a second surgery on Feb. 3, 2012, to remove scar tissue that had built up, which prevented healing. She then underwent further physical therapy. Carter claimed she still suffers pain and was not able to return to work because of work restrictions placed on her by her physicians.
