FACTS
On March 10, 2011, the claimant, a 16-year-old student, was a belted backseat passenger in a Toyota Avalon, which was driven by her father and traveling on a residential street in Los Angeles. Subsequently, the claimant’s father lost control of the vehicle, causing it to run up on the curb and crash into a tree. The claimant sought recovery from her father’s insurance policy, which was administered by Allstate Insurance Co. Allstate did not contest the accident., The claimant was taken to a hospital, where she was diagnosed with a fracture of the left femoral shaft. She subsequently underwent open reduction and internal fixation on March 11, 2011, and then followed up with physical therapy for range of motion and strength issues. The claimant was out of school for a month due to her recovery, though she was homeschooled during that time. She is currently continuing with her physical therapy and has returned to school. Ultimately, she has made a good recovery. Thus, the claimant sought recovery of her father’s policy limits with Allstate.
