On Sept. 6, 2009, plaintiff James Compton was stopped by deputy sheriffs. He claimed that Deputy Leonardo Perez drove him to a dark, secluded place and beat him severely while he was restrained by other deputy sheriffs. Compton sued Perez and his employers, the Riverside County Sheriff’s Department and the county of Riverside. Deputies Gustavo Ibarra, Chad Hill, Robert Vega and Jared Hanson were later added to case as defendants. Compton alleged that the deputies’ actions constituted excessive force in violation of his civil and constitutional rights under 42 USC § 1983. He also alleged that the deputies’ actions constituted assault, battery, and intentional infliction of emotional distress. On June 17, 2014, the court granted summary judgment in favor of Hanson and Hill on all claims, and summary adjudication in favor of the county of Riverside on all claims based on federal law. The remaining portions of the case proceeded to trial against Perez, Ibarra and Vega on claims based on federal and California law, and against the county of Riverside solely on state law claims of respondeat superior., Compton claimed that he sustained physical , including abrasions, contusions and lacerations as a result of the deputies’ actions. He also claimed that he suffers emotional distress as a result of the incident. Thus, Compton sought recovery of past and future medical expenses, and past and future loss of earnings. He also sought recovery of damages for his past and future emotional and physical pain and suffering. In addition, Compton sought recovery of punitive damages.
