On Sept. 25, 2009, plaintiff Laroyal Brumfield, an unemployed 21 year old, was a front seat passenger in a silver, 1999, Honda Civic that was traveling on northbound Churaposa Street in Victorville when his car entered the intersection with Dakota Street and was struck head-on by a vehicle operated by Donna Blasko. Brumfield claimed to his left knee and right wrist. Brumfield sued Blasko, alleging that the defendant was negligent in the operation of her vehicle. Specifically, Brumfield claimed that Blasko made an unsafe left turn directly in front of his vehicle, resulting in a severe head-on collision. Blasko conceded liability after her deposition., Brumfield claimed he suffered a torn lateral meniscus of his left knee and a right, non-dominant wrist fracture. He was subsequently treated at the scene, taken to a hospital, and later released. On Nov. 11, 2011, Brumfield underwent arthroscopic surgery on his left knee, followed by three months of physical therapy. He treated his right wrist fracture with cortisone injections and physical therapy. Brumfield claimed that he did not have any significant residual complaints after treatment. Defense counsel contended that Brumfield’s were soft tissue and/or degenerative in nature. Thus, counsel contended that six to eight weeks of physical therapy was sufficient to treat the attributable to the accident.
