FACTS
On June 7, 2016, plaintiff Aaron Namoca, 17, was walking with a friend in south Sacramento. They were approached by a police patrol vehicle occupied by Sacramento Police Department officers Johnny Lopez and David DeLeon. Namoca and his friend were questioned by the officers. Namoca was eventually brought to the ground, had his hands brought behind his back, and was handcuffed. He also had his cell phone seized, and he was detained in the patrol vehicle for approximately 20 minutes. Namoca’s friend was also detained in the patrol vehicle. During that time, the officers searched Namoca’s cell phone and conducted records checks to determine if Namoca should be arrested and booked into jail. The officers ultimately released Namoca from the patrol vehicle. Namoca claimed that he sustained to his face and right shoulder during the incident. Namoca sued DeLeon; Lopez; the officers’ employers, the city of Sacramento and the Sacramento Police Department; and the officers’ supervisors, Police Chief Samuel Somers Jr. and Deputy Chief of Police David Peletta. Namoca alleged that the defendants’ actions constituted excessive force and battery, an unreasonable seizure and search of property, unreasonable wants and warrants records searches, false detention and arrest, prolonged detention and de facto arrest, negligence, and intentional infliction of emotional distress in violation of federal and state law civil rights claims, including the Bane Act. Namoca claimed that the officers accused him of tampering with a mailbox and that when he denied doing that, Lopez tackled him, placed him in a headlock and punched him multiple times. He also claimed that DeLeon pinned him to the ground by applying his knee to the back of his neck and bearing down. Namoca further claimed that one of the officers wrenched his right arm forcefully behind his back, his shoulder, and then performed an improper search and seizure to see if they could arrest him., Namoca claimed that he was punched near his head, neck and upper body. He also claimed that he sustained a dislocated shoulder and a black eye during the incident. He sought medical care, and he was required to wear a sling on his right arm for approximately one week. He was also informed by medical staff that there is now a greater risk that his right shoulder could become dislocated in the future. Namoca claimed that, as a result of his , he had to miss two weeks of work, which caused him to lose his job. Namoca sought recovery of damages associated with his loss of wages as well as his pain and suffering.
