FACTS
At around 11:51 a.m. on May 16, 2013, plaintiff Placida Namkoong, 54, a postal service mail carrier, was delivering mail at the residence of Amanda Bruner and Erik Bruner, in Huntington Beach, when a Labrador retriever, owned by the Bruners, jumped on her. As a result, Namkoong came into contact with a wall and allegedly sustained to her right shoulder, lower back, and both knees. Namkoong sued the Bruners, alleging that the Bruners failed to control their dog. The Bruners ultimately admitted liability, and the matter proceeded to a trial on damages., Namkoong claimed that she suffered a cervical sprain and strain, muscle spasms, a medial meniscus tear of the right knee, a posterior cruciate ligament tear of the right knee, chondromalacia of the right knee, and 4-millimeter protruding lumbar discs at the L1-2 and L2-3 levels with radiculopathy. She also claimed she injured her right shoulder, requiring an arthroscopic subacromial decompression with bursectomy. Namkoong also underwent epidural steroid injections to the lumbar spine and physical therapy. Namkoong sought recovery of approximately $68,000 in medical costs. She also sought recovery of damages for her past and future pain and suffering. Defense counsel disputed the extent of Namkoong’s and the amount of damages she sought.
