FACTS
On Nov. 29, 2012, plaintiff Cassie Freeman, 28, an employee of PIMCO, was at a company boot camp in Newport Beach with five other PIMCO and AGI employees. Freeman was told by her instructor, Greg LeFever, to attach an exercise band to a table and then do an exercise that required her to be under the table. As Freeman started to perform the exercise, the band pulled the table over, causing a sharp edge to slam into her head. Freeman sued LeFever for negligently instructing her to perform the exercises with the band attached to an unsecured table. Specifically, Freeman alleged that the table was on wheels and that it was not heavy enough to sustain the weight of the exercise. Thus, she claimed that LeFever should have checked to make sure the table was secured prior to instructing her to do the exercise., Freeman sustained a 27-centimeter scalp laceration, which required stitches. She was left with an immature scar in the left pretrichial area of her forehead. Freeman claimed she has no pain and is left with no physical limitations, but that she suffers from embarrassment and humiliation as a result of the physical scarring to her face.
