FACTS
On Oct. 16, 2018, plaintiff Lilliam Pando, 70, a house manager, was driving in Manhattan Beach. Her vehicle entered the intersection of 31st Place and Flournoy Road and was struck on the front, passenger door by a vehicle operated by Jonas Wahlstedt. Pando sustained of her chest and a leg. Pando sued Wahlstedt the owner of Wahlstedt’s vehicle, Johan Wahlstedt. Pando alleged that Jonas Wahlstedt was negligent in the operation of his vehicle and that Johan Wahlstedt was vicariously liable for Jonas Wahlstedt’s actions. Pando also alleged that Johan Wahlstedt was liable for negligently entrusting the vehicle to his son, Jonas Wahlstedt. Defense counsel did not contest liability., Pando sustained a closed, combined fracture of her right leg’s tibia and fibula, just above the ankle joint. She also sustained a slightly displaced fracture of the sternum. Pando was taken to a hospital, where she underwent open reduction and internal fixation to repair the leg fractures. Approximately seven months after the collision, Pando underwent a bone graft surgery with stem cell injections on her right leg to improve the healing of the fractures. Several months after the initial surgery, Pando returned to work, but she claimed that she suffered lingering pain and could not work more than a few hours a day. She claimed that she could not climb stairs or carry heavy items and that her daughter had to step in and do her job for her. Pando further claimed that, for approximately one year, she was entirely reliant upon friends and family to run all of her errands and that she was reliant upon her son to prepare her dinner every night for many months. Pando was able to return to work and live an independent life following her second surgery. Pando sought recovery of past medical costs, and damages for her past and future pain and suffering. Defense counsel contended that Pando had pre-existing psoriatic arthritis, fibromyalgia and insomnia, so Pando was an “eggshell” plaintiff.
