FACTS
On June 26, 2009, plaintiff Heather Hall, an unemployed 45 year old, was walking down one of the aisles of a Vons grocery store in Redlands when she allegedly slipped and fell. She claimed to her left knee and right elbow. Hall sued The Vons Companies Inc., alleging that the defendant failed to properly maintain the aisles, creating a dangerous condition. Hall claimed that she slipped on a puddle of water. At deposition, plaintiff’s counsel submitted video surveillance footage, which they claimed depicted a lack of proper maintenance at the store. Plaintiff’s counsel also deposed former employees of the Redlands store, who claimed that sweep logs may not accurately reflect the maintenance conducted. The Vons Companies disputed whether or not the puddle of water existed, and claimed that it adequately maintained the aisles of its Redlands location. It also disputed whether the slip and fall occurred at all., Hall sustained a small fracture of her right elbow, which was casted at a hospital on the day of the accident. She also claimed lower back pain from the fall and an aggravation of a previously injured left knee, resulting in a medial collateral ligament sprain and a torn meniscus. Hall subsequently underwent arthroscopic surgery on her left knee on Oct. 21, 2010, and followed up with physical therapy. Hall claimed she still experiences lower back pain and pain in her left knee, affecting her ability to walk. She also claimed she now has a protruding osteophyte in her right elbow, which requires corrective surgery. Thus, Hall sought recovery of $70,000 in past medical costs, and an unspecified amount of damages for her future medical costs and past and future pain and suffering. Defense counsel contended that Hall wasn’t injured during the alleged accident.
