FACTS
On March 9, 2009, plaintiff James Redcloud, 38, was driving his 2005 Honda Accord on eastbound Alameda Avenue, in Burbank. While attempting to stop for a traffic light that had changed from yellow to red, Redcloud was rear-ended by a 2003 Ford 250 Econoline van driven by Scott Springer. Redcloud claimed to his neck and back as a result of the collision. Redcloud sued Springer and the owner of the Econoline van, Wexler Video, LLC. Redcloud alleged that Springer was negligent in the operation of the van and that Wexler Video was vicariously liable for Springer’s actions. The plaintiff’s accident reconstruction expert opined that the accident was directly caused by Springer’s failure to stop and his failure to abide by the California Vehicle Code., Following the accident, Redcloud was transported by ambulance to Providence Saint Joseph Medical Center, in Burbank. He was diagnosed with a herniated disc at L5-S1, as well as an annular tear. Redcloud subsequently underwent chiropractic treatment and general physical therapy to treat his pain. He also received joint injections, which allegedly failed to provide lasting relief. The plaintiff’s medical experts opined that the Redcloud sustained were directly caused by the rear-end collision. According to plaintiff’s counsel, Redcloud will require a back procedure to treat his lumbar condition. Thus, Redcloud sought recovery of damages for his past and future medical costs, and past and future pain and suffering. His wife, Carlotta Redcloud, filed a derivative claim, seeking recovery for her loss of consortium.
