FACTS
At around 9 a.m. on May 23, 2013, plaintiff Tracy Castorena, 43, a histotechnologist, was in her vehicle that was traveling south on North Glendora Avenue, in Covina. As her vehicle entered the intersection with East Covina Boulevard, it collided with a vehicle operated by Catherine Cabugao, who was traveling west on East Covina Boulevard. Castorena claimed to her left wrist. Castorena sued Cabugao, alleging that Cabugao was negligent in the operation of her vehicle. Specifically, Castorena testified that she had a green light and that Cabugao ran a red light. The plaintiff’s engineering expert testified as to the speed of both vehicles and the forces involved. Cabugao testified that she had a green light and that Castorena’s vehicle ran a red light., Castorena fractured her left, non-dominant wrist. As a result, she was immediately driven by her boyfriend to a hospital. A few days later, Castorena underwent an open reduction and internal fixation surgery with the implementation of hardware. Castorena claimed that despite surgery, her wrist still causes her pain. She also claimed she is restricted from many of her activities of daily living and hobbies such as baseball and golf. The plaintiff’s expert hand/wrist surgeon testified that Castorena was having pain from the implanted hardware and that it needed to be removed, which would require another surgery costing $30,000. Thus, Castorena sought recovery of future medical costs, as well as recovery of damages for her past and future pain and suffering.
