FACTS
On April 9, 2011, at around 4:55 p.m., plaintiff Marcella Bethel, 49, was a passenger in a 1998 freightliner with a flatbed. The freightliner, which was operated by Randy Lee Howerton, was traveling 45 to 50 mph on westbound Highway 152, east of Ferguson Road, when it overturned onto its right side. Bethel claimed to her right shoulder and arm. Bethel sued Howerton; Nolan R. Campbell, who was doing business as Nolan Campbell Inc.; and Mustang Trucking Inc. Bethel alleged that Howerton was negligent in the operation of the freightliner and that Campbell and Mustang Trucking were vicariously liable for Howerton’s actions. Specifically, Bethel claimed that as Howerton attempted to make a left turn to continue on the highway, he turned at too fast a speed and caused the freightliner to overturn., Bethel claimed she injured her right shoulder and upper arm in the crash. She also claimed that she continues to suffer pain in her arm and shoulder.
